NOTICE
PURSUANT TO SCHEDULE 5A, PARAGRAPH 2(2)
(‘the Notice’)
in respect of an Initial Demolition Notice
THIS NOTICE is given by Aspire Housing Limited of Kingsley, The Brampton,
Newcastle-under-Lyme, Staffordshire, ST5 0QW (‘Aspire’)
Intention to Demolish
Aspire intends to demolish the following premises and shown shaded pink on
a plan which is available at Aspire’s office and on our website
www.aspirehousing.co.uk (‘the relevant premises’):

Reasons for Demolition
The demolition of the relevant premises is necessary for the development of
new homes. The clearance area is part of a wider regeneration scheme within
the Housing Market Renewal Pathfinder Programme for the Knutton and Cross Heath area.
Proposed Demolition Period
Aspire intends to demolish the relevant premises within a period commencing
on 1st October 2008 and ending on 31st March 2012.
Date by which the Initial Demolition Notice shall no longer have
effect
These Initial Demolition Notices will remain in force until 31st March 2012
unless revoked or otherwise terminated under or by virtue of paragraph 3 of
Schedule 5A of the Housing Act 1985 (‘the Act’)
Effect of the Initial Demolition Notice
Whilst these Notices are in force, Aspire will not be under an obligation to
make such a grant as is mentioned in Section 138(1) of the Act in respect of
any claim to exercise the preserved right to buy or the right to acquire in
respect of any of the relevant premises.
This Notice does not prevent the tenant making a claim, or taking steps in
connection with any such claim up to the point where Section 138(1) comes
into force, or the operation of Section 183(1) in most circumstances where
the notice ceases to be in force.
However, if Aspire subsequently serves a Final Demolition Notice in respect of the relevant premises, the right to buy will not arise in respect of the relevant premises while that notice is in force and any existing claim will cease to be effective.
Right to Compensation Where –
(a) a tenant has claimed to exercise the right to buy, and
(b) before Aspire has made to the tenant the grant of a right to buy, either an Initial Demolition Notice is served on the tenant under Schedule 5A or a Final Demolition Notice is served on him under paragraph 13 of Schedule 5, and
(c) the tenant's claim is established before that notice comes into force under Schedule 5A or paragraph 13 of Schedule 5 (as the case may be); the tenant may be entitled to a claim for compensation.
If, within the period of three months beginning with the date when the notice comes into force (“the operative date”), the tenant serves on Aspire a written notice (accompanied by receipts and other documents showing the expenditure was incurred) claiming an amount of compensation as set out in the following paragraph Aspire shall pay that amount to the tenant. Compensation shall be paid in respect of expenditure reasonably incurred by the tenant before the operative date in respect of legal and other fees, and other professional costs and expenses, payable in connection with the exercise by him of the right to buy."
